Adventurebase GmbH Terms and Conditions

Adventurebase GmbH (hereinafter referred to as Adventurebase)

All deliveries, services, offers, and arrangements from Adventurebase are exclusively based on these terms and conditions. The German version is legally binding. By ordering a gift voucher or signing up for an experience, you're agreeing to these terms. You can place an order or register either in writing or verbally. The person ordering or registering must inform other participants (if registering for multiple people) and/or gift recipients (if giving a voucher) about these General Terms and Conditions. We hereby reject any general terms and conditions from the buyer.

Adventurebase organizes and arranges experiences throughout Switzerland and in nearby countries with various event organizers. You can book these experiences by buying value vouchers or through direct booking.

Only value vouchers are available. You'll see the value on your invoice, and you can always ask us about it. These value vouchers can be used for any Adventurebase offer as long as they're valid. You can have a specific offer chosen by you printed and described on the voucher, but don't worry, it's not actually binding when you redeem it.

4.1. Brokerage contract
The brokerage contract is created when the buyer places an order or registers on the website and accepts the general terms and conditions. An order by telephone or e-mail replaces the order by online form. The organizer alone is responsible for the implementation. In this case, Adventurebase is the intermediary and not the organizer. When registering for the experience, the customer receives the organizer's contact details and concludes a separate contract with the organizer regarding the implementation. This contract for the use of the respective experience is concluded directly between the participant in the experience and the respective experience partner (organizer). The legal relationship between the customer and the experience partner (organizer) is governed exclusively by the general terms and conditions of the experience partner. Value vouchers are credited to the offer of the experience partner.

4.2. Sales documents
The information in our sales documents (descriptions, drawings, illustrations, dimensions, weights and other services) are only to be understood as approximate values and do not constitute a guarantee of properties unless they are expressly designated as binding in writing. Adventurebase accepts no responsibility for product information provided by partners.

4.3. AI Consultation
In certain areas, like customer chat, customer inquiries are answered by AI. The answers provided by the AI may contain errors and should therefore only be understood as initial guidance. If anything is unclear, you can always ask for a human employee.

Prices are subject to change, and we reserve the right to correct any printing errors.

6.1. Payment for Vouchers
You can pay for vouchers by invoice or online. Vouchers can only be used for an offer once the full invoice amount has been received. The payment deadline for the invoice still applies in this case.

6.2. Payment for Registrations
Direct registrations can be paid by invoice or online, and payment must be made at least 3 days before the activity. If you don't pay on time, Adventurebase might cancel the activity. However, you're still bound by your registration contract, and cancellation fees will apply.

6.3. Payments from Abroad
Any bank charges for transfers from abroad are your responsibility. Your voucher or registration will only be activated once the full invoice amount has been paid.

7.1. Voucher Validity
Your voucher's value is valid for up to 10 years, as per Swiss law (OR). During these 10 years, you can use any voucher for any Flightbase or Adventurebase offer.

7.2. Extension 
You can extend your voucher's value for free, one year at a time, up to a maximum of 10 years.

7.3. Cash Payout
A cash payout of the voucher value isn't possible. This also applies if the experience you originally chose is no longer available or you no longer want it. In such a case, the voucher value can be used for any other experience from Adventurebase's offerings.

7.4. Transferability
Vouchers are freely transferable and aren't issued to a specific person. Adventurebase isn't responsible if a lost or stolen voucher is redeemed unlawfully.

7.5. Registration Validity
When you register for a specific experience, the offer price valid at the time of registration (registration date) applies. This price is guaranteed for the experience for at least 6 months after the registration date.

If an experience voucher you're using to sign up has an explicit, longer price guarantee, that longer period will replace the standard guarantee. The main thing is that you register (book) within that valid price guarantee period, and the voucher covers the whole experience when you sign up.

If your experience happens after the guarantee period has ended, and the price for that experience has gone up since you booked, you might need to pay the difference as an extra charge.

7.6. Experience Availability
Adventurebase always tries to keep its range of experiences current. If a specific partner stops offering their activity or leaves the Adventurebase program, your voucher will still keep its full value and can be used for any other experience from the Adventurebase selection. You won't be entitled to a refund in this case.

8.1. Shipping Costs Switzerland 
Adventurebase covers the shipping costs for vouchers within Switzerland. You won't have any extra costs.

8.2. Shipping Outside Switzerland
Vouchers are available as downloads abroad. No vouchers will be sent by post outside Switzerland.

8.3. Delivery and Service Times 

Dates and delivery times are non-binding unless we've explicitly agreed otherwise in writing. Any specific delivery times and dates given by Adventurebase depend on our suppliers and manufacturers delivering to us correctly and on time.

8.4. Default of Acceptance 
If the buyer refuses to accept the delivered items after a set grace period, or states they don't want to accept the goods, Adventurebase can refuse to fulfill the contract and claim damages for non-performance. Adventurebase is entitled to claim either a flat rate of 25% of the agreed purchase price or compensation for the actual damage incurred from the buyer.

8.5. Defects
You need to report any visible quantity differences to Adventurebase and the carrier in writing immediately upon receiving the goods, and hidden quantity differences within 4 days of receipt. Complaints about damage, delays, loss, or poor packaging must be reported immediately upon receiving the shipment.

8.6. Transfer of Risk 
The risk transfers to the buyer as soon as the shipment has been handed over to the person carrying out the transport. If shipping is delayed or becomes impossible through no fault of ours, the risk passes to the buyer upon notification that the shipment is ready. Adventurebase covering transport costs doesn't affect the transfer of risk.

9.1. Voucher Returns
You can cancel vouchers up to 20 days after the order date for a processing fee of CHF 25.- per voucher. If the voucher hasn't been sent yet, the processing fee is waived. You don't need to send the vouchers back.

9.2. Excluded from Returns
Products not directly related to the voucher can't be returned.

9.3. Exchanging / Crediting Vouchers
During its validity, the voucher's value can be credited towards a new voucher order or a new registration for any Adventurebase offer.

10.1. Bookings
Bookings are binding. To protect yourself in case of illness, accident, etc., we recommend taking out travel cancellation/cancellation cost insurance. It's up to the customer to arrange this insurance.

10.2. Cancellations and Rescheduling of Bookings
Appointments can be cancelled or rescheduled in writing using the respective web form. Only written cancellations or reschedules via web form or postal mail are accepted during business hours from 08:00 to 17:00, Monday to Sunday. These must always include the ticket code or voucher code. Cancellations made outside business hours will be dated to the next possible business hour. The date Adventurebase receives the declaration is decisive. Cancellations by phone, email, WhatsApp, or other channels apart from the designated web form are not valid.

10.2.1 Cancellation more than 48h before the appointment:
Processing fee of CHF 25.- / person (Exception: CHF 30.- / person for all simulator offers)

10.2.2 Rescheduling more than 48h before the appointment:
Processing fee of CHF 25.- / person. (Exception: CHF 30.- / person for all simulator offers)

10.2.3 Cancellation or rescheduling between 48h and 24h before the appointment:
Fee of 30% of the total price.

10.2.4 Cancellation or rescheduling within 24h or less before the appointment:
Fee of 100% of the total price.

10.2.5 Special rules for all River Rafting, Canoe, and Canyoning offers:
- up to 28 days before the activity date: CHF 40.- / person
- 27 to 10 days before the activity date: 30% of the total price.
- 9 to 2 days before the activity date: 75% of the total price.
- After that or in case of no-show on the activity date: 100% of the total price.

For partial cancellations of group reservations (reduction in participant numbers), the customer must pay the following percentages of the booked event's costs, per customer/participant:
- up to 10 days before the activity date: no costs
- 9 to 3 days before the activity date: 75%
- 2 days or less before the activity date: 100%

10.2.6. Special rules for all Dog Sledding offers:
For every cancellation, the customer will be charged the following percentage of the costs:
- Up to 20 days before the activity starts: 100%

If the event cannot take place because the customer is late or doesn't show up at all, they will pay 100% of the agreed price. Additional costs incurred due to rescheduling or the customer's late arrival are at their expense. If the event starts later or ends earlier, there is no claim for a refund. If the customer changes the activity date up to 30 days before it begins, a processing fee of CHF 50.- per person will be charged. If the activity is rebooked later than 30 days before the original date, the cancellation policy comes into effect.

10.2.7. Special rules for Ziesel Driving, Quad Biking, Houserunning, Airboarding, Snowshoe Hiking:
29 - 20 days before activity start: 20%
19 - 10 days before activity start: 50%
9 - 4 days before activity start: 80%
3 days before activity start: 100%

10.2.8. Special rules for Igloo Overnight Stays:
Up to 60 days before event: CHF 25.-
Up to 30 days before event: 10%
Up to 7 days before event:   50%
6-0 days before event:    100%

10.2.9. Special rules for Gold Panning:
Appointments can only be rescheduled or cancelled with a valid doctor's note.

10.2.10. Special rules for Excavator Driving:
For every cancellation/rescheduling, the customer will be charged the following percentage of the costs: up to 20 days before activity start 20%, up to 10 days before activity start 30%, 5 days before activity start 100%
The activity takes place in all weather conditions.

10.2.11. Special Rules for Shooting Activities:
You can cancel your course up to three weeks before it starts without any extra charges. For cancellations made closer to the date, we can't refund the course fee. You can always transfer your booking to someone else without any extra cost. The activity goes ahead no matter the weather.

10.2.12. Special Rules for Bungee Jumping, Canyon Jump
If you cancel within 48 hours of your booking, a 100% cancellation fee applies.

10.2.13. Special Rules for Canyoning Amden
100% of the cost applies if cancelled within 20 days before the activity starts.


10.3. Group Registrations

For group registrations (multiple people), the registering person is responsible for passing on these terms and conditions to all participants and is liable for any cancellation costs for all participants.

10.4. Cancellation / Postponement by Adventurebase
Adventurebase and its partners can cancel or postpone confirmed dates for important reasons (especially weather and safety reasons, technical reasons, pilot illness, cancellation by other participants, etc.). This can happen at very short notice, even immediately before the activity starts. Incidental costs for travel, food, etc., are borne by the participant and will not be covered by Adventurebase. Such a postponement does not constitute a breach of contract but is part of the experience itself.

If Adventurebase cancels, dates will be rescheduled to a new preferred date for the customer. An automatic rescheduling to the second preferred date provided during registration or a provisional reservation of the second preferred date is not possible.

Your voucher or ticket stays fully valid for a new date within 12 months of the cancellation. You can simply enter your new preferred date using our rescheduling form. Just so you know, we generally don't offer refunds if you reschedule. We'll only cancel your booking if you specifically mentioned during registration that rescheduling isn't an option for you. In that case, vouchers can be used for a different experience. If you booked without a voucher, we'll refund the price you paid for that specific booking, after deducting any costs not directly related to the activity.

11.1 Times and offer description
The times stated in the product descriptions and registration confirmations are approximate and may vary depending on weather, wind and safety reasons. The guide can also postpone the locations at short notice for weather and safety reasons. If an activity is canceled early by the customer, the activity is deemed to have been carried out. In special cases, the guide may terminate an activity early for safety reasons or due to the participant's condition, whereupon the activity is also deemed to have been carried out. If the participant arrives at the appointment under the influence of drugs or alcohol, the activity will be refused and the activity will be deemed to have been carried out.

11.2. weather decision
The weather decision, if necessary, will be communicated to the customer by the guide in accordance with the information in the confirmation email. If the weather is uncertain, the weather decision can also be made at short notice. The customer also has the opportunity to obtain information from the guide regarding the weather trend before the actual weather decision is made.

11.3. Communication obligation and availability for the weather decision
The guide is the primary contact person for the operational implementation and the weather decision. The binding method of contact specified in the registration confirmation is decisive for both parties. Depending on the information provided, the following applies:

1. If the customer needs to contact the guide:
The customer is obliged to actively contact the pilot at the agreed time using the contact number provided.

2If the guide contacts the customer:
The customer is obliged to be available at the time specified on the telephone number provided when booking (via phone call, SMS or standard messenger services).

If the agreed contact is not established at the time specified (because the pilot is demonstrably not available or the pilot does not respond as announced), the customer is obliged to contact the Adventurebase main office immediately on +41 71 554 80 79 during the published opening hours. If the customer does not comply with his obligation to cooperate (active contact or availability and immediate notification in the event of no contact), the service is deemed to have been canceled by the customer if the activity is not carried out and the voucher/ticket is deemed to have been redeemed. In this case, there is no entitlement to a refund or free rebooking.

11.3. Participant requirements
In order to participate in certain experiences, there are special physical requirements such as maximum body weight and maximum height. It is the participant's responsibility to check and comply with these requirements. The specific restrictions can be viewed for each experience. If a guest is rejected on site due to these physical requirements, the voucher or ticket and the entitlement to the booked experience will be forfeited.

11.4 Punctuality of the customer and consequences of delay
The meeting time communicated in the registration confirmation is binding for the customer. The activities are bound to tight time slots, which depend on weather conditions, clearances or connecting bookings, etc.

If the customer is late, the safe and scheduled execution of the activity can no longer be guaranteed. The pilot or guide on site is therefore entitled to start or cancel the activity without the delayed customer. In this case, the service is deemed not to have been commenced by the customer (so-called no-show). The entitlement to the activity expires without replacement and the voucher or ticket is deemed to have been redeemed. There is no entitlement to a refund or a free rescheduling of the date.

12.1 General information
Most of the experiences on offer take place outdoors in nature and are dependent on wind and weather. Postponements can therefore always occur, even at short notice before the planned start date. Safety is our top priority.

12.2. Dog sledding
In the event of a lack of snow, the dog sledding tours are carried out using a wagon with wheels.

13.1 Deliveries
Complaints regarding damage, loss or poor packaging must be reported in writing to Adventurebase and the carrier immediately upon receipt of the goods, hidden quantity differences within 4 days of receipt of the goods.

13.2 Activities
If the customer has cause for complaint or suffers damage, this must be reported in writing to the executing body (organizer) within 5 days and confirmed. This confirmation is not an acknowledgement of guilt. The address of the responsible organizer can be requested from Adventurebase. The organizer will make every effort to remedy the situation within the scope of the event and the possibilities. If no or insufficient remedial action is taken or if the customer wishes to assert claims for damages, the claims must be submitted in writing to the organizer and a copy to Adventurebase within 2 weeks of the contractual end of the activity. The complaint must be accompanied by confirmation from the organizer and any evidence. All claims are forfeited if the complaint is submitted late or not submitted at all during the activity or if the claim is submitted late.

You need to have non-occupational accident insurance (like SUVA) and health insurance. These are your responsibility and you might need to show them on site if asked. By participating, you confirm that you're insured against accidents during the activity you've booked. Please note that Adventurebase GmbH, the pilot/guide/experience partner doesn't provide accident insurance.

We also recommend getting cancellation insurance, which is also your responsibility. 

15.1. Damages
Claims for damages arising from impossibility of performance, breach of contract, culpa in contrahendo and tort are excluded both against us and against our vicarious agents, unless intentional or grossly negligent action is involved. Liability claims arising from an experience must be addressed to the organizer. If a participant does not follow the instructions of the organizer, activity leader, etc., any liability on the part of the organizer shall lapse.

15.2. Liability
Flightbase acts solely as an intermediary between the customer and the performing partner company. The contract for the provision of the flight service is concluded directly between the customer and the partner. Flightbase is therefore not liable for the provision of services, non-performance or poor performance, or for damages caused by the partner company or its auxiliary persons. Any claims arising from the execution of the activity must be directed directly to the partner company. Flightbase will support the customer in asserting their claims where possible.

Trogen AR is the exclusive place of jurisdiction for all disputes arising directly or indirectly from the contractual relationship.

The legal relationship is subject to Swiss law. Should one or more provisions of these General Terms and Conditions be or become invalid and/or incomplete, a legally valid regulation that comes closest in its effect to the invalid and/or incomplete provision shall take its place. The invalidity and/or incompleteness of a provision shall not affect the validity of the other provisions.

Passengers and participants from the USA or Canada expressly waive jurisdiction in the USA or Canada for any disputes arising from the activity and acknowledge that neither Adventurebase GmbH nor the guide/pilot/experience partner will agree to jurisdiction in the USA or Canada.

The German original version of the General Terms and Conditions is always legally binding.
